Overstay becomes a violation of Immigration Control and Refugee Recognition Act.
Article 70 (1) of Immigration Control and Refugee Recognition Act stipulates that a person falling under any of the following items is to be punished with imprisonment or imprisonment without work for not more than 3 years or a fine not exceeding 3 million yen, or is to be subject to the cumulative imposition of imprisonment or imprisonment without work and a fine.
(v) a person who remains in Japan beyond the permitted Period of Stay (including the period for which a person may reside in Japan pursuant to the provisions of Article 20, paragraph (5) (including as applied mutatis mutandis pursuant to Article 21, paragraph (4))) authorized without obtaining an extension or change thereof.
